APPEAL FROM THE COURT OF CLAIMS

1. A paymaster in the army from whom public funds had been stolen, the amount of which he subsequently paid to his chief paymaster pursuant to the order of the Paymaster General, filed his petition in the Court of Claims for relief under secs. 1059 and 1062 of the Revised Statutes. Held that the limitation of six years prescribed by sec. 1069 is applicable to the case.

2. United States v. Clark, 96 U. S. 37, distinguished.
