No. 338

Argued April 23, 1891

Decided May 11, 1891

140 U.S. 445

APPEAL FROM THE DISTRICT COURT OF THE UNITED

STATES FOR THE DISTRICT OF WEST VIRGINIA

Syllabus

An application for rehearing, made after the adjournment of the term at which the final decree was entered, is made too late.

A decree which determines the whole controversy between the parties, leaving nothing to be done except to carry it into execution, is a final decree for the purpose of appeal, and nonetheless so that the court retains the fund in controversy, for the purpose of distributing it as decreed.
