Syllabus

Court's grant of certiorari to decide whether employees may sue for overtime allegedly withheld in violation of the Fair Labor Standard Act if the complaint of that violation was also subject to grievance and arbitration provisions of a collective bargaining agreement held improvidently granted in view of subsequent disclosure that those provisions did not apply to all disputes, but merely those based on violations of the agreement.
